The yearly assessment is comprised of 2 parts: 1) General and 2) Siltation Prevention and Dredging.
The Siltation Prevention & Dredging Assessment is 40% of the General Assessment. (Per Class Action case: WLIC vs. James)
Since 1952 there is an established assessment based on use per property classification.

2010 Lake Permit / Use Fees

Boat Fees: $30.00
Motor Fees: $30.00
Assigned Access Area Space: $175.00 (Docks are not charged)
Lease Dock Rental: $350.00
Lake Front Property Docks: $175.00/per dock
Lake Permit Fees are voted upon by the membership and only require simple majority, these fees do not require court approval because they are not lien-able on property. A member must have all assessments paid by March 31 of each year to be a member in “Good Standing”, or lake privileges may not be assigned and loss of access space could occur.

WLIC NEW USER FEE EFFECTIVE JULY 6, 2009
On May 26, 2009 Judge Lee Hull, Platte Co. Circuit Court approved our previous filing for the “New User Fee”. The fee
will be collected on all property sales closings on or after July 6, 2009.
If you recall from our prior correspondence the Weatherby Lake Improvement Company (WLIC) Board approved a New
User Fee resolution on June 16, 2008. The WLIC subsequently filed for court approval based on long standing precedents,
which was approved on May 26, 2009.
The Board worked for some time developing a fair and equitable way to pay for the continuing operation, improvement and
maintenance of the WLIC and it’s property while remaining sensitive to keeping our annual assessments and lake permit fees
as reasonable as possible. As a result of many long range planning discussions, the Board adopted a two phase method of
generating the revenue needed. The first phase was concluded last year with the court approved Annual Assessment
increase which provides for a 3% yearly inflation index. The second phase broadened the already in place new user fee
established by a Board Resolution in 1989, later approved by the Missouri Court of Appeals in the case known as the
WLIC vs. Fuhrman. Briefly, this original fee is charged to a new member when a purchase/sale of property takes place
which results in an increase in membership. However, if a buyer moves in, and a seller moves out, no fee is collected.
When originally conceived, there were more building lots available which meant new homes could be built and new members
generated. Over the years the revenue fell short as more existing homes sold and fewer new members were generated.
A current WLIC member choosing to buy additional or different property will not be subject to the New User Fee. The
Fee pertains to sales of property only, not inheritance, gifts, etc.
The New User Fee does not replace the old user fee nor does it result in a double fee, in that one or the other is applied, but
not both. All sales of property in Weatherby Lake that create a new WLIC member (regardless of a member count
increase) will result in a fee being collected according to property class, by the title company at the sale closing. The fee as
shown below is at the same rate and uses the same ratios currently used in the original Fuhrman user fee. This fee will thus
require new members/residents to share in the costs that have been paid by current residents over the years to maintain the
WLIC property. Like fees that go to the City of Weatherby Lake, this fee goes directly to the WLIC and is the sole
responsibility of the new member/resident.
